Returns - The Legal Information
The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier, acquires physical possession of the goods.
To exercise the right to cancel, you must inform us within the cancellation period stated.
For ease, you may use the model cancellation form which can be found in the 'Returns' section of the main website.
You can electronically fill in and submit the model cancellation form or submit your intention to cancel the contract between yourself and ourselves by any other clear statement via email, at returns@nicolajanecouture.com.
For ease and speed, please include your Invoice Number, Customer Number, Product Number, whether you wish to obtain a refund or exchange, and a detail of any faults (if returning the goods due to receiving a faulty item).
We will communicate to you an acknowledgement of receipt of such a cancellation on a durable medium (by email) without delay.
To meet the cancellation deadline, it is fundamental that you send your communication concerning your requirement to exercise the right to cancel before the cancellation period has expired, and take reasonable steps to ensure the communication has reached us. Failure to meet these terms will result in the contract failing to be cancelled and goods being unable to be returned for remedy; (refund or exchange). The goods will therefore be deemed unequivocally accepted by yourself.
As per the The Consumer Protection (Distance Selling) Regulations 2000, we do not accept for return a sale of any magazines, or items that are known by the consumer to be faulty prior to purchasing the goods.
Items offered for sale via consignment and therefore owned by a third party and not ourselves are not eligable for return. These items are clearly marked in the individual items description.
Returns and refunds are not offered for special order items and items sourced for you.
EFFECTS OF CANCELLATION:
If you cancel this contract within the specified time limit and providing that all terms and conditions set out in this section are met, we will reimburse to you all payments received from you for the goods themselves; not including the costs of delivery incurred from sending the goods out to yourself, nor the costs to be incurred by yourself to return the goods to ourselves; these are to be covered by yourself. Your statutory rights are not affected.
Goods must be received back with us in the same condition they were received by you (all goods are thoroughly checked and photographed prior to delivery to ensure that all goods are in the same condition as described when the contract was entered into, as they are upon receipt by yourselves). This includes that the goods must have in tact, and not tampered with; the 'returns seal'; this constitutes a ribbon tag, and/or tamper-proof adhesive stickers on the sole(s) of shoe(s). The goods must also be returned with everything they came with; including but not limited to; dust bags, original receipts, authenticity cards, care cards, documentation as to authenticity, original packaging, spare heel tips, etc.
Any goods returned to us in a condition other than that in which they were received by you, with missing items, or otherwise to what is stated above, may be returned to you at your cost, and you will be refused the right to reimbursement of the goods. Alternatively; if we do decide to accept the goods for return, we may make a deduction from the reimbursement to you, for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you or a third party.

We will initiate the reimbursement without undue delay, and not later than:
(a) 14 days after the day we receive back from you any goods supplied, or
(b) if there were no goods supplied, 14 days after the day on which we are informed about your decision to cancel the contract.
We will make the reimbursement using the same means of payment as you used for the initial transaction, unless we have expressly agreed otherwise.
We will withhold reimbursement until we have received the goods back, and they have been inspected by our team.
By purchasing goods and entering into a contract, you agree that you shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day in which we acknowledge your intention to cancel the contract and return the goods, and subsequent to you having expressed your cancellation of the contract to us by the means outlined above and in the 'returns' section of this website. The deadline is met if you send back the goods before the period of 14 days has expired.
You will bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
You are liable for all goods, subsequent to your receipt of the goods, including receipt by a third party other than the carrier, whilst in your care or the care of a third party until they are received, upon your return, by us.
DELIVERY:
The time frame stipulated for deliveries is to be viewed as a guide only, as we use third party delivery services/couriers, we cannot guarantee the delivery dates stated.
SELLING WITH NJC:
When selling to us, the images that you send us, along with the description you provide form part of the contract with us, with which you are legally bound. All information, including pictures that you send, will form conditions of the contract. Any description discovered to be false, or failure to disclose information about the items as to their condition or anything else, including pictures, will result in no payment being made and the goods being returned to you, at your cost. With regard to authenticity, any item found to be inauthentic, will be returned to you at your own cost. Postage costs and any import duties that are due must be covered prior to items being returned. If return postage costs are not covered, items will not be returned.
For consignment pieces, in addition to the above, to sell on your behalf NJC will take a percentage of the total selling price in return for authenticating your piece, marketing it and finding a buyer. The fee that we charge will be discussed with you in the communication stage, and prior to any agreement being formed. You are under no obligation to consign with us until both yourselves and ourselves are happy to proceed.
We always check and authenticate items in person before making our final quote. Any quote provided prior to handling the goods in person is a guide as to how much your item(s) may achieve. Any items that do not meet our standards will be returned to you at your cost.
For items exchanged, if the value of your items is less than that of the item you are wanting to exchange with, then you can pay the difference in price. If the value of your items is more than the item you are wanting to exchange with, then the remainder of the balance will be given in store credit.
For items sold to us for store credit, the credit will expire 24 months after it is issued.
We do not cover the costs of delivery or import duties for items sent to us.

CUSTOMS DUTIES AND TAXES:
We are based in the UK, and Customs Duties and Taxes may be payable on any items being purchased outside of the UK. The buyer is responsible for all Customs Duties and Taxes due on the item(s), and Nicola Jane Couture will not cover these costs, nor be liable to reimburse the buyer for items that have not been accepted for delivery due to a failure on the buyers part to pay the Customs Duties and Taxes owed.
In the event that the buyer does not accept the goods from Customs, or returns the goods whilst they are still held at customs, for any reason that is beyond our control; the goods will only be returned to the buyer if the buyer pays for the goods to be re-sent, plus any fees incurred to Nicola Jane Couture Ltd must also be payed before the goods will be re-sent. Alternatively a refund will only be provided to the buyer if requested, and will be minus any delivery costs and all fees, duties and expenses incurred by Nicola Jane Couture Ltd.
Nicola Jane Couture, in it's sole discretion, reserves the right to not confirm an order, or cancel an order, and provide a refund in full (if the buyer is not at fault), including but not limited to, if the buyer is purchasing goods from a country whereby it would be illegal to supply those goods.
Nicola Jane Couture reserves the right to not confirm an order, or cancel an order and provide a refund in full if the buyer is not at fault, for any other reason. A contract will only be formed when we dispatch the goods. All information on our website is an invitation to treat and not an offer or unilateral contract. By placing an order, this constitutes a legally binding offer by you to purchase our goods, and acceptance of your offer to buy is made by us when we dispatch the goods.
